2. Making A Order

2.1: To order goods through this website you must be at least 18 years of age and accept delivery within the UK. When ordering online you are deemed to place the order through our secure online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement by email, detailing the products you have ordered, again allowing you to check that all details and requirements were correctly submitted to us. This information is also available to view by logging into your account online using your password and username created on registration.

2.2: Our acceptance of an order takes place when we despatch the order. Even if your payment has been processed immediately, Bathempire.com reserves the right, at any time prior to acceptance, to refuse any order or any part of an order, or to require further or better information to enable it to evaluate and/or process the order.

2.3: We may refuse to accept an order:
(a) where goods are out of stock or no longer available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.

3. Products Pricing & Availability

3.1: All prices include VAT (where applicable) at the current UK rates. All prices are shown inclusive of VAT at all stages throughout the searching/ordering process, and all prices quoted in addition to this website by phone or by email shall also be given inclusive of VAT at all times.

3.2: In the event that there is a pricing error on the website then Bathempire.com will not be bound to honour any orders made at that price.

3.3: Unlike most online shops or traders who have to order their goods from the manufacturer after receiving your order. All of our items are PHYSICALLY in stock in our warehouse for immediate dispatch.

5. Cancellation and Returns Policy

5.1: If you wish to cancel your order:
(a) you can notify us by phone on 02476 389052 before we have dispatched the goods.
(b) Where goods have already been dispatched to you, by returning goods to us in accordance with clause 5.2 below. The cost to safely and securely return any unwanted items lies solely with the purchaser.

5.2: Returns Policy - Returns Form: Returns must be made with a completed returns form. These can be downloaded from the bottom of this page. You agree that if you send a return to us without a returns form you will pay a £20 administration fee to cover the extra work involved in processing your return. We provide refund for items purchased within 14 days. Postage is non-refundable. Please make sure the return item is in pristine condition with its original box and packaging. You will be responsible for the cost of return delivery and safe return of goods. If goods are sent back without care and damage is caused during transit, we will not be able to offer refund, so please make sure you pack the item so no damage can occur.

5.3: Returns Policy - Faulty Goods: For your peace of mind, all of our goods come with varies 1 to 5 years warranty. Please read the following terms before your purchase.

In unlikely event that a manufacturing fault does occur we will try to replace the part within 3 working days. We will cover postage cost for sending replacement parts to any UK address, but cannot be held responsible for any 3rd party costs or compensation in any way for damage to the item or other goods. All returns are tested and if the item proves not to be faulty when tested then only the product value will be refunded. You will be charged the cost of the deliveries.

The provisions of these clauses do not affect your statutory rights.

6. Licence

6.1: You are permitted to print and download extracts from this Website for your own "non-commercial" use on the following basis:

(a) no documents or related graphics on this Website are modified in any way;
(b) any of our copyright and trade mark notices on images or within text appear in all copies displayed.

12.2: Whilst we endeavour to deliver all goods in the times quoted at point of ordering, on occasion there can sometimes be delays which are out of our control and sometimes unforeseen. We will endeavour to notify you of any delays foreseen where possible, but we shall not accept liability for any losses, damages, or costs incurred due to a delay in delivery. We urge you not to arrange to have parts fitted or modified until such time as the parts have safely arrived with you as we will not accept responsibility for any cancellation or fitting fees incurred as a result. On the rare occasion that goods are loss in transit, the goods will be replaced for an identical product. We will not issue a refund. All goods are supplied specific to the vehicle details that we are given at point of ordering. In the event that you fail to notify us of a vehicle modification that may lead to a part or parts not fitting correctly it will be at our discretion as to wether a bank credit or credit note is issued, unless goods have been specially ordered whereby they may be non returnable. We will not be held responsible for any fitting costs incurred by the customer on goods supplied. If goods have been incorrectly supplied it is your responsibility to notify us of this prior to fitting stage. On goods fitted that are later found to be faulty compensation is not guaranteed and is at the discretion of the manufacturer.

12.3: Nothing in these terms and conditions shall exclude or limit our liability for (i) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.
